Agreement to Terms

By accessing or using the services provided by PublicProof LLC ("PublicProof," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use our services.

Services

PublicProof provides marketing automation and revenue recovery services for home service businesses. Our services include but are not limited to missed-call text-back automation, review request automation, lead follow-up sequences, CRM pipeline management, and reporting.

No Guarantee of Results

While our systems are designed to help capture missed leads, generate reviews, and improve follow-up, PublicProof does not guarantee specific results, revenue increases, or return on investment. Results vary based on factors including but not limited to your call volume, job volume, customer participation, service area, and market conditions. Any examples, projections, or case studies are illustrative and not guarantees.

Payment Terms

Services are billed on a month-to-month basis with a one-time setup fee due at the time of enrollment. Monthly fees are charged on the same date each month. Setup fees are non-refundable as they cover the labor and configuration required to build and customize your system. All fees are in U.S. dollars.

Cancellation

You may cancel your subscription at any time with 30 days written notice. Upon cancellation, your system will be deactivated at the end of your current billing period. There are no cancellation fees. Setup fees are not refundable.

Client Responsibilities

To receive the full benefit of our services, you agree to:

  • Provide accurate business information during onboarding
  • Grant necessary platform access (via admin invitations, not passwords)
  • Complete the intake form within 5 business days of enrollment
  • Mark jobs as completed using your chosen trigger method
  • Respond to negative review drafts within 48 hours

PublicProof is not responsible for delays or reduced results caused by incomplete or late information from the client.

Communication Consent

By enrolling in our services, you consent to receive communications from PublicProof via email, SMS, and phone for service-related purposes. You may opt out of marketing communications at any time. See our SMS Policy for details on text message communications.

Intellectual Property

All automations, workflows, templates, and systems built by PublicProof remain the property of PublicProof LLC. Clients receive a license to use these systems for the duration of their active subscription. Upon cancellation, access to these systems is terminated.

Data and Privacy

We handle your data in accordance with our Privacy Policy. Upon cancellation and written request, we will provide a one-time CSV export of your contacts if your account is in good standing.

Limitation of Liability

PublicProof shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue, arising from or related to your use of our services. Our total liability shall not exceed the amount you paid to PublicProof in the three months preceding the claim.

Modifications

We reserve the right to modify these Terms at any time. We will notify active clients of material changes via email. Continued use of our services after changes constitutes acceptance of the updated terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
